Acceptance of Terms

By downloading, installing, or using BenchVoice ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the App.

Beta Software

BenchVoice is currently available through TestFlight while paid App Store launch proof is completed. Beta software can contain bugs or incomplete behavior.

We recommend regularly exporting important team data during beta and before major roster, device, or account changes.

Use License

We grant you a limited, non-exclusive, non-transferable license to use BenchVoice for personal or team use. You may not:

  • Copy, modify, or distribute the App
  • Reverse engineer or attempt to extract the source code
  • Use the App for any illegal purpose
  • Remove any copyright or proprietary notices
  • Use the App to violate any laws or regulations
  • Interfere with or disrupt the App's functionality

User Content

You are solely responsible for the data and content you enter into BenchVoice. You retain all rights to your data. By using the App, you grant us the right to store and process your data to provide the App's functionality, including iCloud synchronization.

You represent and warrant that you have all necessary rights to any data you enter into the App and that such data does not violate any third-party rights.

Data Backup

BenchVoice includes export and restore features, and may use iCloud sync when enabled. You are responsible for maintaining backups of important team data.

iCloud and Shared Links

BenchVoice can use Apple's iCloud services for synchronization. Your use of iCloud is subject to Apple's terms and privacy policy. If you publish or send shared team links or exported files, you are responsible for who receives and accesses them.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms of Service.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of any changes by updating the "Last updated" date at the top of this page. Your continued use of the App after such changes constitutes acceptance of the modified terms.

Termination

We may terminate or suspend your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App will immediately cease.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

Severability

If any provision of these Terms of Service is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
